General
The following is the service agreement between HosterDirect Inc.  (hereafter referred to as HosterDirect) and the personal or business account holder ("You").

PLEASE READ CAREFULLY BEFORE USING OUR SERVICES.  IF YOU DO NOT AGREE TO ABIDE BY THIS AGREMENT PLEASE DO NOT USE OUR SERVICES.  HosterDirect may terminate your account(s) at anytime without notice for conduct that is in breach of this agreement, or for conduct that HosterDirect identifies as harmful to services provided by HosterDirect, or is harmful to any other party.

Your use of the Service must be in compliance with Canadian and US laws and laws of your country at all times.

HosterDirect reserves the right to modify this agreement at anytime without notice.   You are responsible to read this agreement from time to time to ensure that your use of the services remains in compliance with this agreement.  

Prohibited Conduct
You will violate this agreement if you engage in the following prohibited activities while using our Services:

• Spamming
Sending unsolicited commercial e-mail/massages (spamming) to promote products and/or services.   If you conduct this activity, HosterDirect reserves the right to delete your mailbox without any notice or compensation to you.

• Hacking
Accessing illegally or without authorization computers, accounts, or networks belonging to HosterDirect or another party, or attempting to penetrate security measures of another individual's system.

• Server Abuse
Consume excessive system or networks resources that disrupts the normal use of HosterDirect services, but not limited to, spawning multiple processes, consuming excessive amounts of memory, CPU or bandwidth usage.

• Infringing Intellectual Property Rights
Content that infringes or violates any intellectual property rights of others, including, copyright, patent, trademark, service mark, trade name, trade secret, or other intellectual property right of any third party.

• Promoting Violence Activities
Promoting or providing information to carry out physical harm or injury against a person or any group, or any other illegal activity against any persons, government, business or other entities.

• Obscene Materials or Speech
Display, advertise, transmit, store, post, or otherwise exploit child pornography (under 18 years of age) and obscene nudity.  HosterDirect will notify the law enforcement agencies when it becomes aware of the exploitation of child pornography using HosterDirect services.

Content that is disgustingly offensive to the community, including blatant expressions for bigotry, prejudice, racism, hatred or excessive profanity, or any filthy, excessively violent and harassment.

Billing Cycle
Payment is due every 30 days form the date on which your HosterDirect account is created or every 365 days if the account is paid for yearly.  You will be automatically charged UNLESS a cancellation request has been sent to billing@hosterdirect.com and HosterDirect has confirmed your request.  Cancellation request must be sent 5 business days prior to next billing date.

Payment Policy
All payments are payable in US Dollars and due on your account's Billing Cycle.

HosterDirect accepts payment by MasterCard, Visa, American Express or PayPal.  If you provide us with your credit card or PayPal information, you authorize HosterDirect to automatically charge the any payments/fees due on your HosterDirect account.  Recurring payments will be automatically charged to your credit card or Paypal until you cancel your account in accordance with our cancellation policy.

You are responsible for keeping updated your credit card or PayPal information in your account.  This includes but is not limited to credit card numbers, expiration dates, or billing address.

Frequently HosterDirect offers a FREE domain registration for a year when you sign up for hosting services; to be eligible for this offer, you must keep your hosting account active for a period of 12 months.  If your account is cancelled within 12 months you will be charged $15 for your domain registration.  Not to be combined with any other offer.

Bank Charge Backs
All Bank Change Backs and billing disputes result in the termination of your HosterDirect account.  HosterDirect will report all Bank Charge Backs to the issuer’s Credit Agency.

If a Bank Charge Back is made on domain name registration or renewal fees, you loose all ownership and administrator rights to the domain name(s).

If the Bank Charge Back was made due to an error on you side, you will be required to pay a $35.00 reinstatement fee for charge back received by HosterDirect before your services and/or domain name will be reactivated.

Cancellation Policy
Services will automatically renew until a service is cancelled.  If you do not wish to renew your monthly or annual service agreement you must cancel your account by sending an email to our billing department at billing@hosterdirect.com.

You can cancel your service agreement at any time.  If within the first 30 days following the initial order, a full refund will be issued.  This is referred to as our 30 day money back guarantee.  Please allow 5 business days for a refund to be processed.  BE AWARE THAT THERE IS NO PRO-RATED REFUNDS AFTER THE FIRST 30 DAYS OF SERVICES REGARDLESS OF YOUR BILLING CYCLE.

Domain Name Registrations CANNOT be cancelled.  As the purchaser of the Domain Name you are the Domain Name’s owner until the term of the Domain Name’s Registration has expired.  

HosterDirect reserves the right to terminate your account(s) at anytime without notification for conducts that is in breach of this agreement.  No refund will be given in such a situation.

Domain Name Registration
HosterDirect offers Domain Name Registration and renewal services in partnership with ICANN accredited registrar eNum Inc.  HosterDirect processes registration and renewal services through this respective registrar at its discretion.  In addition to this agreement, new domain registration accounts are also subject to the Domain Registration Agreements of the respective governing registry.  Domain Registration Agreements can be found at: https://www.enom.com/terms/default.asp

30 Day Money Back Guarantee
All most every service carried by HosterDirect offers a 30 Day Money Back Guarantee.   If you are not fully satisfied with our services, you will be provided with a full refund during the first 30 days of the services.

Domain Name Registrations or Domain Name renewals do not qualify for the 30 Day Money Back Guarantee.

Termination of services due to violation of this agreement is not eligible for a refund.

Price Changes
HosterDirect will never increase the billing prices for services from the date of purchase.   However, HosterDirect reserves the right to change prices listed on hosterdirect.com, and the right to increase the amount of resources given to services at any time.
